Distance Sales Agreement

1. Parties This Agreement has been signed between the following parties under the terms and conditions specified below: A. ‘BUYER’ (hereinafter referred to as "BUYER" in the contract) B. ‘SELLER’ (hereinafter referred to as "SELLER" in the contract) By accepting this Agreement, the BUYER acknowledges that if the order subject to this contract is approved, they will be obligated to pay the order amount and any additional costs such as shipping fees and taxes, and that they have been informed about this.

2. Definitions In the application and interpretation of this contract, the following terms shall have the meanings set forth below: MINISTER: Minister of Customs and Trade, MINISTRY: Ministry of Customs and Trade, LAW: Law No. 6502 on Consumer Protection, REGULATION: Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), SERVICE: Any consumer transaction other than providing goods in exchange for a fee or benefit, SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf of or for the account of the supplier, BUYER: A natural or legal person acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes, WEBSITE: The website belonging to the SELLER, ORDERING PARTY: A natural or legal person who requests a good or service through the SELLER’s website, PARTIES: The SELLER and the BUYER, CONTRACT: This agreement concluded between the SELLER and the BUYER, GOODS: Any tangible movable property that is subject to shopping, including software, sound, images, and similar intangible goods prepared for use in electronic environments.

3. Subject This Agreement regulates the rights and obligations of the parties concerning the sale and delivery of the product(s) whose specifications and sales prices are stated below, ordered by the BUYER electronically via the SELLER’s website, in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. The listed and announced prices on the site are the sales prices. The announced prices and promises remain valid until updated and changed. Time-limited prices remain valid until the specified period expires.

7. Information on Product(s) Subject to the Contract 7.1. The essential characteristics of the good(s)/service(s) are published on the SELLER’s website. If the SELLER has organized a campaign, the relevant product's essential characteristics can be reviewed during the campaign period. The campaign is valid until the specified date. 7.2. The listed and announced prices on the website are the sales prices. The announced prices and promises remain valid until updated and changed. Time-limited prices remain valid until the specified period expires. 7.3. The total sales price of the product/service, including all taxes, is shown below:

7.4. The shipping cost of the product will be paid by the BUYER.

9. General Provisions 9.1. The BUYER acknowledges, declares, and undertakes that they have read and understood the basic characteristics of the product subject to the contract, the sales price, payment method, and delivery terms as provided on the SELLER’s website and have confirmed these details electronically. 9.2. The delivery of each product shall be made within a maximum period of 30 days, depending on the BUYER’s place of residence, as specified in the preliminary information section on the website. If the product cannot be delivered within this period, the BUYER reserves the right to terminate the contract. 9.3. The SELLER shall deliver the product subject to the contract in full, in accordance with the specified qualifications, and with the necessary documents such as warranty certificates and user manuals, in compliance with legal regulations.

10. Right of Withdrawal 10.1. The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery without assuming any legal or penal liability and without providing any justification. 10.2. The right of withdrawal must be exercised by sending a written notification via registered mail, fax, or email within the 14-day period. The product must be unused and returned with its original invoice and all accessories in an undamaged condition.

11. Products for Which the Right of Withdrawal Cannot Be Exercised Personalized products, perishable goods, hygiene-related items, and digital content services cannot be returned if their packaging has been opened after delivery.

12. Default and Legal Consequences If the BUYER defaults in payment by credit card, they acknowledge that they will be responsible for interest payments and any legal actions taken by the issuing bank.

13. Competent Court In case of disputes arising from this contract, the BUYER may apply to consumer arbitration committees or consumer courts within the limits set by the relevant law.

14. Enforcement When the BUYER makes the payment for the order through the website, they are deemed to have accepted all the terms of this contract. The SELLER is responsible for ensuring that the BUYER has read and agreed to this contract before finalizing the order.
